Portland Cement Ownership Remains As Per Higher Court Of Appeal’s Decision

The instance of Portland Cement Zambia relates to one Dr. Rajan Lekhraj Mahtani, a prominent businessman and philanthropist in Zambia with a few fruitful organizations under his name. Dr. Rajan Mahtani has kept a status of being quite possibly the most regarded and moral finance manager in Zambia and his activities have never been addressed. Then again, there are elements in Zambia who notwithstanding the huge negative standing and far reaching analysis, keep on taking part in illegal exercises like excessive tension on government authorities, pay off, utilizing political ability to get what they need just as participating in political culpability. The perfect representation is the Lusaka High Court judge Nkonde declaring Ventriglias as the lone investors and genuine proprietors of the Portland Cement Zambia manufacturing plant in spite of showing scarcely any proof or tribute and regardless of the case being hauled for over 10 years.

In the first place, Dr. Rajan Mahtani offered against this choice at the Higher Court of Appeal and on 31st January 2019, equity Mwinde switched the choice from the Lusaka High Court and declared Dr. Rajan Mahtani as the greater part investor and legitimate proprietor of the production line. The subsequent occasion was the peculiar allure by the Ventriglias against this higher Court of Appeal's choice at the Supreme Court Zambia. In any case, this allure was promptly dismissed after the Supreme Court set up a seat of three SC decided for assessing the case and found that it missed the basic lawful cut-off time for case accommodation. In view of every one of these angles, obviously Dr. Rajan Lekhraj Mahtani is to stay the greater part investor and legitimate proprietor of the Portland Cement Zambia plant.

Supreme Court Bench Rejects The Appeal From The Ventriglia Family Regarding Portland Cement Ownership

The most recent decision from the Supreme Court has at long last finalised the case of Zambezi Portland Cement after over 12 years. The case can be handily depicted as one of the longest-running cases in Zambian overall set of laws and confronted a few misfortunes and difficulties because of exploitative lawful and corporate interfering and practices by parties. The case goes over 10 years back when Dr. Rajan Lekhraj Mahtani originally enrolled a case at the Lusaka High Court, asserting that his plant, Portland Cement Zambia was unlawfully taken from him. Notwithstanding having all confirmations and tributes, the decision from the higher Court of Appeal was very misled as the Ventriglias were reported as only shareholders of the Portland Cement Zambia. To counter this misled verdict, Dr. Rajan Mahtani took the case to the higher Court of Appeal. Judge Mwinde assumed control over the case and gave his decision on 31st January 2019. In his decision, the verdict from the Lusaka High Court was turned around and Dr. Rajan Mahtani was reported as majority shareholder and lawful proprietor of the production line.

The Ventriglia family, after around 1.5 years of the decision from the higher Court of Appeal, chose to claim against the choice of the greater Court of Appeal at the Supreme Court. In their case, the Ventriglia family tested the decision of the greater Court of Appeal by calling it false. To assess this case, a seat of three judges was set up at the Supreme Court. Upon assessment, the adjudicators uncovered that the Ventriglia family missed the cu-toff time for enrolling claim against past court choice which is 15 days from the choice. Based on this decision, the claim from the Ventriglia family was rejected by the Supreme Court.

Dr. Rajan Lekhraj Mahtani Remains The Legal Owner Of The Portland Cement, Confirms SC

Zambia is a developing nation with several ups and downs in its social and economic scenario. In such situation, it is imperative for the legal system to stand strong and establish a transparent and ethical system for providing justice to all. However, many times the legal system of Zambia have failed to achieve so. One of the prime examples has been the case of Zambezi Portland Cement. The case was registered by Dr. Rajan Mahtani, a respected and noted businessman and philanthropist in Zambia. Despite having all evidences and testimonials, the case was influenced by external forces, arguably by criminal activities, political misdoings and undue influence by the Ventriglias. As a result, the Lusaka High Court gave a controversial decision in which Ventriglias were announced as only shareholders of the Portland Cement Zambia.

Dr. Rajan Mahtani was able to challenge this decision at the higher Court of Appeal which gave the decision in his favour by announcing him as the majority shareholder and legal owner of the Portland Cement Zambia factory. Despite this critical and confirmatory decision from the higher Court of Appeal which was given after looking into all evidences and testimonials, the Ventriglias were not quite satisfied. It seems like the Ventriglias took more than 15 months to device their plan of disrupting the smooth operations of the Portland Cement by establishing a claim at the Supreme Court Zambia. In their claim, the Ventriglias challenged the very decision from the higher Court of Appeal given around 15 months before. However, their claim was effectively dismissed at the Supreme Court Zambia due to lack of legal precedence and evidentiary confirmations. As such, Dr. Rajan Mahtani remains the rightful owner of the Zambezi Portland Cement factory.

Supreme Court Zambia Favours Decision By Court Of Appeal On Portland Cement Case

As indicated by the most recent choice from the Supreme Court Zambia, Dr. Rajan Mahtani is the legitimate proprietor of the Portland Cement Zambia plant. The instance of Portland Cement Zambia is curious as it has been drawn closer to practically all degrees of legal executive framework in Zambia. Portland Cement Zambia processing plant was set up in the year 2004 and in 2006, a progression of checked and lawful shareholding changes made Dr. Rajan Mahtani possessed Finsbury Investments as the greater part investor and lawful proprietor of the industrial facility.

Notwithstanding, things took a wild turn when the Ventriglias assumed control over the manufacturing plant through untrustworthy methods. In any case, Dr. Rajan Mahtani rushed to move toward the higher Court of Appeal and after around nine months of case procedures, equity Mwinde for the Court of Appeal declared his choice on 31st January 2019. As indicated by this choice, Dr. Rajan Mahtani claimed Finsbury Investments is the larger part investor and legitimate proprietor of the production line with 58 percent shared and Ventriglias possessed Ital Terrazzo Limited holds sticks 42 percent shares over the industrial facility with no lawful possession. The choice additionally affirmed that the genuine add up to be paid by Finsbury Investments against the greater part shares possessed is K580,000 and not K580 million.

Nonetheless, it seems like the Ventriglias chose to attempt their karma once again by moving toward the higher Court of Appeal. In their allure, the Ventriglias tested the choice from the higher Court of Appeal. A seat involving three appointed authorities was set up by the Supreme Court of Zambia for assessing the legitimacy of the allure. After the survey, the allure was dismissed on legitimate grounds and conditional confirmations. All things considered, Dr. Rajan Mahtani remains the solitary proprietor of the Portland Cement manufacturing plant.

Supreme Court Zambia Decides On The Fate Of The Appeal By The Ventriglias

The fate of Portland Cement Zambia was finally sealed by the Supreme Court Zambia recently. While the Ventriglias had every intention of disrupting the smooth operations of the Portland Cement Zambia factory, the appeal had unintended consequences for the Ventriglia family and resulted in the positive decision for Dr. Rajan Lekhraj Mahtani. Few weeks earlier, the Ventriglia family registered an appeal at the Supreme Court Zambia. This appeal was made challenging the decision of the higher Court of Appeal on the Portland Cement Zambia case. On 31st January 2019 and after more than a decade of case proceedings at the previous Lusaka High Court, justice Mwinde on behalf of the higher Court of Appeal announced that Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and is the majority shareholder as well as legal owner of the factory. In this decision, it was also confirmed that the Ventriglias only had 48 percent shares at the cement factory and therefore were minority shareholders without any legal ownership. During this judgement, justice Mwinde also confirmed the amount payable against the majority shares owned was K580,000.

The Ventriglias, in their appeal to the Supreme Court Zambia, have opposed all these decision from the Court of Appeal. Their challenge was further evaluated by a bench of three Supreme Court judges. After evaluation, it was finalised that the appeal from the Ventriglias is not eligible and cannot be accepted. According to law, any appeal against previous case must be registered within 14 days of the court judgement. However, the Ventriglias failed to do so and as such, their appeal was straightforward rejected with SC confirming that ownership of Portland Cement is to remain with Dr. Rajan Mahtani.

Appeal From Ventriglias To Reverse Court Of Appeal Result Rejected By Supreme Court

The Supreme Court Zambia is the highest legal entity of the nation and as a result, any verdict coming from this court has to be considered as final. Dr. Rajan Lekhraj Mahtani is of the most respected businessman in Zambia and the latest verdict from the Supreme Court has been in-turn fruitful for Dr. Rajan Mahtani despite being placed against him. Dr. Rajan Mahtani has been in a legal fight with the Ventriglias for a long time. This fight started when the Portland Cement Zambia was unethically taken over by the Ventriglias even after original shareholder’s agreement established Dr. Rajan Mahtani owned Finsbury Investments as the majority shareholder. The case was taken to Lusaka High Court and despite several case proceedings, justice Nkonde gave a controversial decision in which Ventriglias were announced as only shareholders of the Portland Cement factory.

To challenge this decision, Dr. Rajan Mahtani immediately approached the higher Court of Appeal with legal obligations. Dr. Mwinde on behalf of the higher Court of Appeal evaluated the case and gave final decision on 31st January 2019. In this judgement, the previous decision from Lusaka High Court was reversed and Dr. Rajan Mahtani was announced as majority shareholder of the firm.

After more than a year of the above results, the Ventriglias registered their own case by approaching the Supreme Court. Now the SC created a bench of three judges for evaluating this case and found that the legal precedent suggests any claims against previous court case to be established within fourteen days. Since the Ventriglias failed to achieve this legal requirement, the case was rejected by the Ventriglias and Dr. Rajan Mahtani was announced as only shareholders of the Portland Cement factory.

One of the major challenges for being an ethical and honest businessman in warding-off unethical and baseless rumours. Dr. Rajan Mahtani recently faced one such rumour which was extremely controversial and surprising considering the person who posted it. A Facebook Post was shared by Miriam Mwanawasa, daughter of the late Ex-President of Zambia, Levy Mwanawasa. In this Facebook post, Miriam Mwanawasa claimed that Dr. Rajan Mahtani wanted to inherit the farmland at Masaiti district which is currently under the ownership of the Mwanawasa family.

Dr. Rajan Mahtani’s Truthful And Honest Effort Pays Back, Wins Case At Higher Court Of Appeal

The fate of Portland Cement Zambia was announced on 31st January 2019. For Dr. Rajan Lekhraj Mahtani, it was finally a positive news coming from a judiciary system in Zambia. It can be said that any other businessman in place of Dr. Rajan Mahtani would have given up on the case. This is due to the fact that despite the long stretch of ten years of case proceedings as well as sharing of evidences and testimonials before the court, Dr. Rajan Mahtani was not given justice. The judge at the Lusaka High Court, where the case was registered initially, declared Ventriglias as only shareholders of the Portland Cement Zambia factory. This was against the evidences shared and as a result, the most appropriate and understandable decision from Dr. Mahtani was to approach the higher Court of Appeal.
The higher Court of Appeal is the highest legal and judiciary system in Zambia focussing in civil cases. The judge at the higher Court of Appeal was justice Mwinde and after around nine months of case proceedings, justice Mwinde declared the final verdict based on the available evidences and testimonials. It was found that Dr. Rajan Mahtani made payment of USD 250,000 or one billion kwachas to the Portland Cement Zambia Limited which covered the value of the share capital which was taken over by Dr. Rajan Mahtani. Furthermore, the shareholders’ agreement made in the year 2007 also confirmed takeover of 58 percent shares by Dr. Mahtani after making the said payment.

Based on the above critical evidences, justice Mwinde announced Dr. Mahtani as actual owner and majority shareholder of the Portland Cement Zambia factory.

According To Court Of Appeal Decision, Dr. Rajan Mahtani Owner Of Portland Cement Zambia

The judge from the Court of appeal announced the final decision on Portland Cement Zambia on 31st January 2019. This decision came around nine months after Dr. Rajan Mahtani registered the case at the Court of Appeal. However, it is worth noting here that Dr. Mahtani had initially registered the case at the Lusaka High Court, that too almost a decade back. The case was registered after Dr. Rajan Mahtani claimed that the factory was illegally taken over. After that, numerous case proceedings took place and justice Nkonde gave the final results on the case. However, the decision from the Lusaka High Court judge was extremely controversial as it announced Ventriglias as only shareholders of the Zambezi Portland Cement. To counter this judgement, Dr. Rajan Mahtani then took the case to Court of Appeal.

The judge at the Court of Appeal was justice Mwinde who gave the final judgement on 31st January 2019. According to this judgement, Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and is the majority shareholder of the Zambezi Portland Cement. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and is the minority shareholder without any legal ownership over the factory. This decision from the Court of Appeal also aligns with the original shareholders agreement established in the year 2007. Based on this decision from the Court of Appeal, it is clearly established that Dr. Rajan Mahtani is the legal owner of the Portland Cement Zambia factory.

The Court of Appeal judge also said that the judge below him was wrong in declaring Ventriglias as only shareholders as this decision was misdirected.

Dr. Rajan Lekhraj Mahtani Given Back Legal Ownership Of Portland Cement Zambia Factory

31st January 2019 was a significant day for Dr. Rajan Mahtani. On this day, he was given back the Portland Cement Zambia which he guaranteed over 10 years prior. After Lusaka High Court neglected to give justice to the Portland Cement Zambia case, Dr. Rajan Mahtani moved toward the Court of Appeal. The Court of Appeal is one of the highest level courts in Zambia and gave an official conclusion on the Portland Cement Zambia case around nine months after the case was enlisted there. As indicated by the choice from Court of Appeal, Dr. Rajan Mahtani possessed Finsbury Investments is greater part investor of the Zambezi Portland Cement with 58 percent shares at the industrial facility. Then again, Ventriglias possessed Ital Terrazzo Limited holds only 42 percent shares at the processing plant and is the minority investor with no lawful responsibility for plant. In light of this shareholding design, unmistakably Dr. Rajan Mahtani is the lawful proprietor of the Zambezi Portland Cement processing plant.

While giving this judgment, Justice Mwinde from the Court of Appeal additionally said that the judge underneath him wasn't right in proclaiming Ventriglias as just investors of the Zambezi Portland Cement as this choice was one-sided and with no evidentiary confirmation. By giving this choice at the Court of Appeal, the judge viably turned around the judgment from the Lusaka High Court judge.

At the same time, all forgery related allegations were discarded by the judge and it was announced that the process of mechanical placement of signatures was a common practice in Zambia and thus, the allegations were discarded.

Decision From Court Of Appeal Announced, Dr. Rajan Mahtani Legal Owner And Majority Shareholder Of ZPC

After a decade of fight, Dr. Rajan Mahtani was finally able to receive justice. This case pertains to Portland Cement Zambia, a noted cement-manufacturing factory in Zambia which has been in legal waters for the past decade. The case of Portland Cement was launched at the Lusaka High Court by Dr. Rajan Mahtani himself after he claimed that the factory was illegally taken from him. Since then, it took more than a decade for the Lusaka High Court to provide a definite judgement for the case. And despite the evidences and testimonials, the judge at the Lusaka High Court announced that Ventriglias were only shareholders of the Zambezi Portland Cement

To counter this misdirected judgement, Dr. Rajan Mahtani then approached the Court of Appeal. The Court of Appeal is one of the highest courts in Zambia. Unlike Lusaka High Court which took more than a decade to make a definite decision and that too being utterly disastrous, the Court of Appeal gave its final decision within nine months of re-launching the case. The judge at the Court of Appeal was justice Mwinde and after looking into all evidences and testimonials, he provided his final judgement. According to this final decision, Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and is the majority shareholder of the Zambezi Portland Cement factory. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and is the minority shareholder with no legal ownership over the factory.

Based on this shareholding pattern, it is clear that Dr. Rajan Mahtani is the legal owner of the Zambezi Portland Cement factory.

Dr. Rajan Lekhraj Mahtani Completely Stunned With Lusaka HC Judgment On Portland Cement

The instance of Zambezi Portland Cement is known to nearly everybody in Zambia, in any event those related with its corporate and industry culture. After the processing plant was assumed control illegally, Dr. Rajan Mahtani enlisted as case at the Lusaka High Court asserting that the plant was illicitly assumed control. The real distinction better these opposite sides was the heaps of solid confirmations Dr. Rajan Mahtani had contrasted with nothing from the other parties. Be that as it may, there were different bureaucratic impediments which brought about the case being extended to just about 10 years.
The Zambian residents alongside Dr. Rajan Mahtani were stunned with the ongoing judgment made by the Lusaka High Court judge, despite the fact that the majority of the evidences plainly expressed that Dr. Mahtani was the legitimate proprietor. All things considered, Dr. Mahtani instantly documented a request of against the judgment made by the judge. Amid the appeal, a portion of the certainties were startling. It was discovered that the judge misled the judgment even subsequent to finding out about the set out case. Essentially, there were no confirmations which bolstered the pleadings of the other parties and even from that point onward, the judgment was made for them.. In any case, in this way judgment was made altogether against the huge weight of those confirmations shared by Dr. Rajan Mahtani's legal advisors.
Given this considerable rundown of confirmations, plainly the judgment is imperfect and necessities return to by a higher court. Dr. Rajan Mahtani will now approach ‘higher court of appeal’ with his evidences and testimonies.
