The Ventriglia family challenged that the verdict given by the higher Court of Appeal in which the previous decision from the Lusaka High Court was rejected and Dr. Mahtani was announced as majority shareholder and legal owner of the factory. Nevertheless, Supreme Court Zambia established a bench of three Supreme Court judges for evaluating the claim. These included Judge Muma Malila, Judge Royda Kaoma and Judge Michael Musonda. During evaluation, it was found that the Ventriglia family failed to comply with the legal requirement in which claims against previous court decisions are to be submitted within 14 days of the court verdict. Since the verdict from higher Court of Appeal was given on 31st January 2019, this means the Ventriglia family was required to submit their case within 14 days from the above decision. Based on these evidences or lack thereof, the Supreme Court bench rejected the appeal from the Ventriglia family. 

Supreme Court Bench Rejects The Appeal From The Ventriglia Family Regarding Portland Cement Ownership

In their case, the Ventriglia family tested the decision of the greater Court of Appeal by calling it false. To assess this case, a seat of three judges was set up at the Supreme Court. Upon assessment, the adjudicators uncovered that the Ventriglia family missed the cu-toff time for enrolling claim against past court choice which is 15 days from the choice. Based on this decision, the claim from the Ventriglia family was rejected by the Supreme Court.
